Telephor-e service tests made recently in Port land by Mrs. Agnes Johnson, ex-employe of the telephone company, were introduced as the first evidence pre sented by Assistant City Attornev Tomlinson in his effort to have the advanced telephone rates effected last March set aside. Mrs. Johnson was in the employ of the company for 12 years, first as an operator, later, as an information oper ator, then as a supervisor and finally as chief operator. Records of the service test made through all of the Portland exchanges -showed that she had sained a re sponse from 339 calls. She testified that she had made a greater number of calls, hut in some instances the telephone subscribers refused to divulge any information after learning that she was employed by the city attorneys office. They expressed fear that their telephones migiit be taken from them. Astoria is complaining according to their attorney, James Mot.t, because she is being called upon" to pay rates which produce a return of 8.6(5 per cent, when computed upon a basis of returns of ten months of the present year, and two months of 1920, or 9.7 percent when computed upon the es timated returns of 1921. He called X. Wigdon, a rate expert in the employ of the telephone company, for the pur pose of establishing the raie of return the company is receiving at Astoria. In her contest Mrs. Leacbetter co-ntonds that the will was the pro duct and result of undue influence exercised over the testator by the men appointed as trustees WORK ON SMALL.FRUIT CENSUS HERE STARTS In the outlining of the survey of tho f;mall fruit and berry industry of Clackamas county, definite work has been started by the county horticul ture project leaders, who at their meeting last week, decided on the sur vey as the first step toward a co operative marketing program. Forms for the col'ection of all data upon the farms and producing areas of the county were sent out Monday by County Agent W. A. Holt. ' The data to be collected includes the loca tion of each orchard, the name and address of the owner, the kind of pro duce, number of trees in growth or bearing, and the yield for the years of 1920 and 1921 together with the shipping point. The survey, when completed, will present an accurate compilation of facts upon the yield in the county r-.i pears, prunes, apnles, raspberries, strawberries, loganberries and nuts. Any small fruit that is produced in 'iiarketabie quantities will be included. Although no definite program' fo' the formation of a marketing associa tion or a co-operative marketing agree ment amonsr the farmers has beet. outlined, such steps will be taken as soon as full information as to the total production of the ;-ounty is in hand. Parker was recovered from the Willamette river Monday afternoon at about 2 o'clock, a "short distance from where th J young man was drowned, which was sear the home of Mr. and Mrs. R. Just as his companions, H. Holliiugsvorth and W. Bullard, start ed towards Parker he sank, never to appear agin. He was considered a fair swimmer, and his friends believe that he was caught in an undercur rent, and he was unable to help him self. The young men made every ef fort to recover the body at that time. Parker came to Oregon City from Springfield, Oregon, last September, and since that time has been employ ed in the Crown Willamette Paper Company's plant at West Linn. The department in which he worked clos ed for Friday afternoon, -when he took advantage of the holiday to go in bathing.
